1. Introduction & Definitions
1.1These Terms & Conditions ("T&Cs") govern the promotional competition known as the MXD Side Quest (the "Competition") held as part of the MXD-branded activation at Ultra Music Festival South Africa 2026 (the "Event"). By participating, all Participants are deemed to have read, understood and accepted these T&Cs in full.
1.2For the purposes of this document: "Promoter" means B&W Productions (Pty) Ltd, together with The South African Breweries (Pty) Ltd (SAB) and Anheuser-Busch InBev SA/NV (AB InBev) (collectively, the "Promoter Parties"). "Participant" means any natural person aged 18 years or older who enters, or attempts to enter, the Competition in accordance with these T&Cs. "Side Quest" means the nine (9) digital mission-based tasks accessed via the QR code located at the Event and completed through the MXD Side Quest web application. "Experience Deck" means the elevated MXD-branded hospitality area at the Event, access to which forms part of Prize Tier 1. "Prize(s)" means the prizes described in Clause 5 below.
2. Eligibility
2.1Age restriction. The Competition is open only to natural persons who are 18 (eighteen) years of age or older on the date of entry, being the legal drinking age in the Republic of South Africa. The Promoter Parties reserve the right to require proof of age (e.g. valid South African ID, passport or driver's licence) at any stage. Any Participant unable or unwilling to provide such proof will be disqualified and forfeit any Prize.
2.2Residency. The Competition is open to legal residents of the Republic of South Africa and visiting nationals physically present at the Event.
2.3Exclusions. The following persons may not participate in the Competition and are not eligible to win any Prize: (a) directors, members, partners, employees, agents, consultants or contractors of any of the Promoter Parties, of B&W Productions, of AB InBev, of SAB, of any participating retailer, of RIO Perfumes, of Ultra Music Festival or of any supplier of goods or services in connection with the Competition; (b) the spouses, life partners, business partners or immediate family members of any person referred to in (a); and (c) any person whom it would be unlawful to supply alcoholic beverages to.
2.4No purchase necessary to participate. In accordance with Section 36(3) of the Consumer Protection Act 68 of 2008, participation does not require the purchase of any goods or services. Entry is achieved by scanning the Competition QR code displayed at the venue and completing the Side Quest free of charge.
3. How to Enter
3.1Locate and scan the official MXD Side Quest QR code displayed at the MXD activation area within the Event venue. This will launch the Side Quest web application on the Participant's personal mobile device.
3.2Complete all nine (9) missions listed in the Side Quest app, which may include photo submissions, video submissions, or presence at designated activation zones inside the Event.
3.3All entries must be submitted during the Competition period at the applicable venue. Entries submitted after the Competition closes, or outside the venue, will not be accepted.
3.4Each Participant may enter only once per Event day. Duplicate entries, entries made using fake identities, automated systems, bots, scripts, or any form of manipulation, will be disqualified.
3.5The Promoter Parties' records of entries shall be final and binding.
4. Nature of the Competition (Not Gambling)
4.1The Competition is a promotional competition conducted in terms of Section 36 of the Consumer Protection Act 68 of 2008 (the "CPA") and is not, and shall not be construed as, gambling, a lottery, or a game of chance within the meaning of the National Gambling Act 7 of 2004.
4.2Participation is free. No consideration, fee, levy or payment (other than the reasonable cost of electronic transmission, not exceeding R1.50 per entry as prescribed by Regulation 11(1) of the CPA Regulations) is required to enter.
4.3The Competition is conducted solely for the purpose of promoting the MXD brand and the entertainment of Event attendees. It is for fun.
5. Prizes
Tier 1MXD Experience Deck. The first one hundred (100) Participants to successfully complete all nine (9) Side Quest missions at each Event will receive access to the MXD Experience Deck for the remainder of that Event day, including complimentary MXD beverages, food and curated bites supplied by the Promoter. Access is non-transferable and subject to venue capacity, safety rules and responsible-service protocols.
Tier 2Backstage with the Ultra DJs. Ten (10) winners per Event, each with one (1) plus-one guest (total 20 people per Event), will be drawn at random from the pool of Side Quest completers. Winners will be escorted backstage to meet participating DJs at times designated by the Promoter (indicatively 20:00 and 21:00). Backstage access is conditional on adherence to Event security protocols, artist availability and the prior consent of Ultra Music Festival production. Plus-one guests must also be 18 years or older and produce valid ID on demand.
Tier 3Luxury Fragrances by RIO Perfumes. Twenty (20) winners per Event will be drawn at random from the pool of Side Quest completers and each will receive one (1) luxury fragrance from the RIO Perfumes range, to a combined prize pool value of approximately R500,000 (Five Hundred Thousand Rand) across both Events. Specific product allocation is at the sole discretion of the Promoter and fragrance partner.
5.1All Prizes are non-transferable, non-refundable and non-exchangeable for cash or any other alternative, except at the sole discretion of the Promoter.
5.2The Promoter reserves the right to substitute any Prize with a prize of equal or greater value without prior notice, where substitution is necessary due to circumstances beyond the Promoter's reasonable control.
5.3All Prizes are awarded "as is" and the Promoter Parties give no warranty, express or implied, in respect of any Prize. Any manufacturer or third-party warranties attaching to a Prize vest in the winner directly.
5.4Any travel, accommodation, transport, incidental or ancillary costs associated with claiming or enjoying a Prize are the sole responsibility of the winner, unless expressly stated otherwise in writing by the Promoter.
5.5Winners must claim their Prize on the night of the relevant Event, at the time and location designated by the Promoter. Any Prize not claimed within 30 (thirty) days of the relevant Event date will be forfeited, and the Promoter shall have no further obligation in respect of such Prize.
6. Selection of Winners
6.1Tier 1 winners are determined on a first-come, first-served basis, based on the time-stamped completion of the ninth (9th) Side Quest mission, as recorded by the MXD Side Quest application.
6.2Tier 2 and Tier 3 winners are determined by random selection from the pool of all Participants who successfully completed all nine (9) Side Quest missions at the relevant Event. Random selection shall be performed by means of a certified randomisation function, or by manual random draw, overseen by an independent third-party accountant, attorney or advocate registered in the Republic of South Africa, in accordance with Regulation 11(5) of the CPA Regulations.
6.3The judges' decisions on the conduct of all draws and the identification of winners shall be final and binding. No correspondence or negotiation shall be entered into.
6.4Winners will be announced from the Event stage and/or notified via the contact details supplied at registration. If a winner cannot be reached, fails to respond, or fails to produce valid proof of identity and age within 30 (thirty) minutes of being called, the Promoter reserves the right to redraw and select an alternate winner.
6.5The Promoter will retain all records required under Regulation 11(6) of the CPA Regulations for a minimum period of three (3) years from the date of the Competition.
7. Responsible Drinking & AB InBev Commitments
7.1This Competition, and all MXD-branded products and communications associated with it, comply with the AB InBev Responsible Marketing and Communications Code (RMCC), the Association for Responsible Alcohol Use (ARA) Code, the Drinks Federation of South Africa (DF-SA) Communications Code of Conduct, and the Advertising Regulatory Board (ARB) Alcohol Industry Code of Conduct.
7.2The Competition, the Event activation, the Side Quest app and all associated marketing materials are directed only at persons of legal drinking age (18 years and older) in South Africa. MXD does not target, appeal to, or seek to influence persons under the age of 18.
7.3Participants are urged to drink responsibly and in moderation. Alcohol will not be served to any person who appears intoxicated or under the age of 18. The Promoter reserves an absolute right to refuse service and/or revoke a Participant's access to any Prize that involves the consumption of alcohol, including the MXD Experience Deck, where in the Promoter's sole reasonable opinion the Participant is, or is at risk of becoming, intoxicated.
7.4Participants and winners are strongly advised not to drive under the influence of alcohol. The Promoter accepts no liability for any Participant's decision to consume alcohol or to operate any vehicle or machinery thereafter.
8. Indemnity, Waiver & Limitation of Liability
8.1Acceptance of risk. Participation in the Competition is voluntary and at the Participant's own risk. The Side Quest involves moving between multiple activation zones within a live music festival environment, which includes inherent risks (crowd density, stage effects, laser and pyrotechnic effects, loud music, uneven surfaces, intoxicated persons, alcoholic consumption, etc.). Each Participant acknowledges and accepts these risks.
8.2Indemnity. Each Participant and, where applicable, each winner and each plus-one guest, hereby irrevocably indemnifies, holds harmless and releases the Promoter Parties — being B&W Productions (Pty) Ltd, The South African Breweries (Pty) Ltd (SAB), Anheuser-Busch InBev SA/NV (AB InBev), RIO Perfumes, Ultra Music Festival, the venue owners of Expo Centre Nasrec and The Ostrich, and each of their respective holding companies, subsidiaries, affiliates, directors, employees, agents, contractors, consultants, sponsors, marketing partners and advisers (collectively, the "Indemnified Parties") — from and against any and all claims, actions, demands, damages, losses, costs (including legal costs on an attorney-and-own-client scale), liabilities or expenses of any nature whatsoever, whether direct, indirect, special, incidental, consequential, punitive or otherwise, arising out of or in connection with: (a) the Participant's participation, or attempted participation, in the Competition; (b) the completion, or attempted completion, of any Side Quest mission; (c) the Participant's presence at the Event or any activation area; (d) any injury, loss, damage, illness or death suffered by the Participant; (e) the consumption (or over-consumption) of any alcoholic beverage; (f) the receipt, use, enjoyment, non-enjoyment, defect, failure or non-delivery of any Prize; (g) any allergic reaction, sensitivity or adverse response to any RIO Perfumes product; (h) any technical failure, unavailability, malfunction or data loss of the Side Quest app, QR code, device, network or server; (i) the acts or omissions of any other Participant, Event attendee or third party; and (j) any event of force majeure, including but not limited to weather, load-shedding, civil unrest, strike, pandemic, governmental order, or cancellation or postponement of the Event.
8.3Limitation of liability. To the maximum extent permitted by South African law, the Indemnified Parties' total aggregate liability to any one Participant arising out of or in connection with the Competition shall not exceed the retail value of the Prize actually awarded (if any) to that Participant.
8.4Nothing in this clause 8 shall exclude or limit any liability which cannot lawfully be excluded or limited under South African law, including liability for gross negligence, wilful misconduct or fraud on the part of the Promoter Parties, or any right of a Participant under Chapter 2 of the CPA that cannot be waived.
9. Content, Intellectual Property & Marketing Use
9.1By submitting any photo, video or other content via the Side Quest app ("User Content"), each Participant warrants that they are the sole author/creator of that User Content, that all persons visible in the User Content have consented to its capture and submission, and that the User Content does not infringe any third-party rights.
9.2Each Participant grants to the Promoter Parties a worldwide, royalty-free, perpetual, irrevocable, sub-licensable and transferable licence to use, reproduce, adapt, edit, publish, distribute and display the User Content, together with the Participant's name and likeness, in any and all media (including social media, print, digital, in-venue screens and AB InBev/SAB internal channels), for promotional and archival purposes related to MXD, Ultra Music Festival and the Promoter Parties, without further consent or compensation.
9.3In accordance with Regulation 11(3) of the CPA Regulations, a winner may decline to permit the use of their image for external marketing purposes without forfeiting their Prize. A winner wishing to decline must notify the Promoter in writing at the time of prize claim. Participants acknowledge, however, that incidental capture of image/likeness within general Event crowd footage is unavoidable and is not subject to this right of decline.
9.4All trade marks, logos, designs, copyright and other intellectual property relating to MXD, AB InBev, SAB, B&W Productions, Ultra Music Festival and RIO Perfumes remain the exclusive property of their respective owners.
10. Personal Information & POPIA
10.1The Promoter Parties will process Participants' personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and their respective privacy policies, which are available on request.
10.2Personal information collected (including name, contact details, age confirmation, ID number for prize claim, photos and videos submitted to the Side Quest app) will be used solely for the purposes of administering the Competition, awarding Prizes, complying with legal obligations (including CPA record-keeping), and — with explicit consent where required — direct marketing.
10.3Participants have the right to access, correct, or request deletion of their personal information, subject to the Promoter Parties' legal record-retention obligations.
11. Disqualification
11The Promoter Parties reserve the right, in their sole and absolute discretion, to disqualify any Participant who: (a) breaches any provision of these T&Cs; (b) tampers with the entry process or the Side Quest app; (c) uses bots, scripts or automated entry methods; (d) engages in abusive, threatening, harassing, obscene or otherwise unlawful conduct; (e) submits any User Content that is offensive, defamatory, indecent, infringing or otherwise unlawful; (f) cannot produce valid proof of age or identity; (g) is visibly intoxicated; or (h) is otherwise found to be ineligible under Clause 2.
12. Changes, Suspension & Cancellation
12The Promoter reserves the right, in its sole discretion and without prior notice, to amend, suspend, modify or cancel the Competition, or to disqualify any Participant, where it reasonably considers it necessary to do so due to fraud, technical failure, force majeure, safety concerns, changes in applicable law, or any other circumstances beyond the Promoter's reasonable control. Such changes shall not give rise to any claim against any Promoter Party.
13. General Provisions
13.1Governing law and jurisdiction. These T&Cs are governed by the laws of the Republic of South Africa. The parties submit to the non-exclusive jurisdiction of the High Court of South Africa, Gauteng Division.
13.2Severability. If any provision of these T&Cs is held by a competent court to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
13.3Availability of rules. A copy of these T&Cs will be made available free of charge to any Participant on request and to the National Consumer Commission, in accordance with Section 36(6) of the CPA. The current version is also available at the MXD activation area and via the MXD Side Quest app.
13.4Entire agreement. These T&Cs constitute the entire agreement between the parties relating to the Competition, and supersede all prior representations, agreements and understandings, whether written or oral.
13.5Contact. Queries relating to these T&Cs may be directed in writing to the Promoter at the address notified on-site at the MXD activation.
